1. Definitions
This website aims to inform about the activities of the Digital Video Broadcasting Project (DVB) and provide a platform of information exchange for its work.

The DVB Project is a not-for-profit association with legal personality governed by articles 60 and seq. of the Swiss Civil Code and by its Statutes. The registered office of the DVB Project is the registered office of the European Broadcasting Union in Geneva, Switzerland.

"Registered Users" refers to all individuals who have been granted access to the Members Only section of this website. (http://member.dvb.org)

"Public Users" refers to all individuals who have not been granted access to the Members Only section of this website. (http://member.dvb.org)

"Users" refers to both Registered Users and Public Users.

2. General
(A) This agreement sets forth the terms and conditions that apply to use of this website’s content and services by Users. By using this website’s content and/or services, Users agree to comply with all the terms and conditions hereof. The right to use this website’s content and/or services is exclusive to each User, and is therefore non-transferable to any other person or entity.

(B) Users are responsible for all use and activities related to their account. It is the responsibility of each Registered User to ensure that their account information is up to date. Users shall be responsible for protecting the confidentiality of account access information such as usernames and passwords, where applicable.

(C) The DVB Project shall have the right at any time to change or discontinue any aspect or feature of its service, including, but not limited to, content, frequency of distribution, and equipment needed for access or use.

3. Changed Terms
The DVB Project reserves the right to change or modify the terms and conditions of service at any time without prior consent of its Users. The DVB Project reserves the right to impose new conditions and delete existing terms. All changes to the terms shall be effective immediately upon notice to the Users, which will be performed via a posting on this website’s main page. Thereafter, continued use of this website content and/or services shall be deemed to constitute acceptance by the User of the modified terms.

4. Equipment
Users shall be responsible for obtaining, installing, and maintaining all telephone, computer hardware, computer software, text, HTML, source code, and other devices needed for access to and use of services offered by this website and all charges related thereto.

The DVB Project shall not be liable for any delays in connection with this website content or from any damages arising therefrom.

5. User Conduct
(A) Each User shall use this website content and/or services for lawful purposes only.

(b) This website offers content and services which are protected under international copyright laws. Users may not modify, publish, transmit, or reproduce any content obtained from this website, except as expressly permitted in the terms of agreement. Users acknowledge that they do not acquire any ownership rights of any content and/or service accessed or obtained from this website.

(C) Users shall not upload, exchange, post or otherwise make available any copyright protected material owned by this website without prior written authorization. Users shall be solely responsible for any damage resulting from the infringement of copyrights.

(D) Registered Users in good standing are granted a reproduction license for content on the condition that it is used to further the objectives of the DVB Project.

(E) This website’s material(s) may not be stored or archived for any purpose, except where expressly permitted.

(F) All reproduction license(s) expire immediately upon termination of this agreement.

6. Disclaimer of Warranty and Limitation of Liability
(A) USER EXPRESSLY AGREES THAT THIS WEBSITE CONTENT AND SERVICES ARE PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

(B) USER EXPRESSLY AGREES THAT USE OF THIS WEBSITE CONTENT AND/OR SERVICES IS AT USER'S SOLE RISK. THE DVB PROJECT DOES NOT WARRANT THAT THIS WEBSITE’S CONTENT AND/OR SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED. THE DVB PROJECT SHALL NOT BE HELD LIABLE FOR ANY ERRORS, OMISSIONS, INTERRUPTIONS, OR DELAYS IN CONNECTION WITH THIS WEBSITE’S CONTENT, OR FROM ANY DAMAGES ARISING THEREIN.

(D) IN NO EVENT WILL THE DVB PROJECT OR ANY PERSON OR ENTITY INVOLVED IN CREATING AND MAINTAINING THIS WEBSITE’S CONTENT AND/OR SERVICES BE LIABLE FOR ANY DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THIS WEBSITE CONTENT AND/OR SERVICES.

7. Indemnification
The User agrees to defend, indemnify and hold harmless the directors, officers and agents of the DVB Project from and against all claims and expenses, including attorneys' fees, arising out of the use of this website by User or User's Account.

8. Termination
Either the DVB Project or the User may agree to terminate this agreement at any time. The provisions of Sections 5(B), 5(C), and 5(F) shall survive termination of this Agreement.
